Under 14 CFR § 107.145(b)(1), what condition applies to a Category 1, 2, or 3 operation conducted within or over a closed- or restricted-access site, over a moving vehicle?

Why: 14 CFR § 107.145(b)(1) requires that, within a closed- or restricted-access site, all human beings located inside a moving vehicle be on notice that a small unmanned aircraft may fly over them.

  • Within a closed- or restricted-access site, AC 107-2A Table 8-1, p. 8-3, shows sustained flight over a moving vehicle is allowed as long as occupants are on notice; the sustained-flight limit only applies outside such a site, under § 107.145(b)(2).
  • No vehicle-stopping requirement exists in § 107.145; the rule conditions the operation on notice to occupants, not on the vehicle's motion.
