Under 14 CFR § 107.150, a small unmanned aircraft system eligible for more than one category of operations over people (for example, both Category 2 and Category 3) may have variable modes or configurations only if —

Why: 14 CFR § 107.150 permits a small UAS to be eligible for one or more categories of operation over human beings "as long as a remote pilot in command cannot inadvertently switch between modes or configurations." AC 107-2A § 8.12 (pp. 8-30–8-31) elaborates that the remote pilot operating instructions must explain how to verify and change the mode or configuration, so the pilot does not inadvertently change it.

  • Imagines an automatic category-selection feature; the regulation is about preventing accidental switching by the pilot, not about the aircraft choosing a category on its own.
  • Confuses a single aircraft's variable modes with the unrelated process of multiple applicants each separately declaring compliance for different aircraft; § 107.150 concerns one aircraft with switchable configurations.
